Divorce and Equity Compensation: What Gets Split, and How

Splitting a house or a 401(k) in a divorce has a well-worn process. Splitting unvested RSUs or stock options does not, and getting it wrong can leave one spouse with a tax bill the other one never sees.

Vested vs. Unvested Is the First Split

Shares that were already vested during the marriage are usually treated as marital property outright. Unvested shares are murkier: many states look at whether the grant was compensation for past service (more likely marital) or an incentive for future service (more likely separate, at least in part), and the grant date relative to the marriage timeline matters too.

A QDRO Doesn't Cover This

A Qualified Domestic Relations Order is built for splitting qualified retirement plans like a 401(k). It does not apply to RSUs or stock options. Dividing equity compensation requires specific language in the divorce settlement itself, and if that language is vague or missing, enforcing the split later can be genuinely difficult.

Valuation Timing Is a Real Fight

Company stock moves. Valuing a position as of the separation date versus the divorce filing date versus the actual vest date can produce very different numbers, especially for a volatile stock. This is worth negotiating explicitly rather than assuming it will sort itself out.

What to Get in Writing

Equity compensation adds a layer most divorce attorneys don't handle daily. A financial plan that accounts for the tax and cash flow reality on both sides makes the settlement language much easier to write correctly the first time.
